Respected Sir,

The complainant/applicant most respectfully submits as under: -

1.          That the complainant is a permanent resident of Union Territory of Jammu and Kashmir and citizen of India and presently residing at her matrimonial home along with her husband namely Gourav Anand and minor baby namely Siona Anand and as such entitled to all the fundamental, legal and statutory rights as applicable to the Union Territory  of Jammu and Kashmir.

 

2.          That it is pertinent to mention here that the complainant is residing in a joint family  and all the accused persons are residing in the same vicinity but number of times on one pretext or the other have harassed the complainant as well as her husband but despite of it the complainant has tolerated all this with the hope that good sense will prevail upon them and moresoever the mother-in-law as well as father-in-law of the complainant have also number of times suggested the accused persons to mend their ways but all goes in vain and the accused persons who are having no respect for the law of the land have started crossing their limits day by day.

 

3.          That the extent of harassment at the hands of accused persons have gone to such an extent that without caring for the family relations and emotions, all the accused persons in connivance with each other and with criminal intention on 2^nd of August, 2020 at about 8:35 pm have assembled together and reached the terrace where the husband of the complainant along with his minor baby were present and there after started verbally abusing the complainant and not only this the accused no. 2 & 3 have caught hold the husband of the complainant and rest of the accused persons thereafter started giving fists and blows to the husband of the complainant and the accused persons were also having rods in their hands as a result of which the husband of the complainant has sustained injuries on his body and thereafter the husband of the complainant has started making hue and cry and after hearing the hue and cry of the husband of the complainant, the complainant has reached the terrace where all the accused persons were present and accused no. 2 & 3 have caught hold the complainant in their clutches and rest of the accused persons have assisted the accused no. 2 & 3 for the commission of the aforesaid crime and when the complainant reached towards her husband so as to save his life, all the accused persons who were having criminal intention so as to kill the husband of the complainant thereafter have started holding the arms of the complainant and it is pertinent to mention here that the accused no. 2 & 3 have outraged the modesty of the complainant and have also torn the clothes of the complainant and rest of the accused persons have assisted the commission of the aforesaid crime and not only this the accused persons have also given fists and blows and slaps to the face of the complainant and passed vulgar remarks towards the dignity of the complainant and when the husband of the complainant have stopped the accused persons from tearing the clothes of the complainant then the accused persons again started beating the husband of the complainant but by the Grace of God, the complainant as well as her husband were able to save their lives from the clutches of the accused persons.

 

4.          That thereafter, all the accused persons have left the spot and while leaving the spot have openly given a threat of life to the complainant as well as her husband and immediately thereafter the complainant has approached the Police Post, Sarwal, Jammu for registration of FIR against the accused persons but the Police authorities of the aforesaid Police Post have started negotiating the matter despite of the fact that the accused persons by taking law in their own hands have committed serious offences for which strict action is required to be taken against the accused persons but till date no FIR has been registered against the accused persons.

              It is, therefore, most respectfully prayed that FIR may kindly be registered against the aforesaid accused persons under Sections 354, 323,341, 506 read with section 34 of IPC and other relevant provisions of law in the interest of justice.

Sir, I again humbly request to please file an F.I.R against Mr Gagan Anand ( working as engineer with Kaphai construction , Jammu) , Neha Anand ( Teacher at MIET Jammu) , Raghav Anand , Ridham anand ,Adarsh Anand ( Branch Manager at Jammu and Kashmir Bank and running catering , real estate and car sale and purchase business ) and Sarita anand ( wife of Adarsh Anand)   for aiding and abetting most deadly assault (  attempt to murder ) on me yesterday evening while i was playing cricket with my young daughter Siona Anand. The brief incidence is as follows.

1)   In the morning my wife approached your police station and especially you on the phone that
	my brother has broken the left front mirror of my new black TVS scotty(  not registered yet).

Taking cognizance of the matter you arrived at our house i.e Qno 336 B and directed my brother ( Gagan Anand) to remain in limits and not to unnecessarily harass my wife. and advised my wife and my brother to remain calm and respect and clearly mutually demarcated parking in front of our house. You also directed Gagan Anand to provide yourself with CCTV footage from 1 of August to verify the person who broke the glass of my wife's scooty.

2)     After you left the was uneasy calm and as usual , all long meetings started at my Uncle home ( Qno 337 A Rehari Colony). But we were not anticipating any such planned attack as we were assured by your visit.

3)     At about 20:35 p.m. , my daughter started insisting me to play cricket and make her practice on the terrace of our home, she also insisted her mother come watch and play. My wife told her she would be coming in 10-20 min and we should carry on.

4)     When I was about to climb the stairs , my sister in law came to the door of his floor and along with her daughter Nidia started poking me and making my video , stating loudly that i have again come to hit her with the bat in my hand. I jokingly told her on camera , looked good and then reached the top floor.

5)     When I reached the terrace ( top floor) where my father and mother live , I saw Raghav Anand sitting there with my father. I specifically told my mother and father why he is here when you people only have complained to police last week that his father ( Adarsh Anand) has threatened you with dire consequences. I left the room and started playing with my daughter .

6)     After about 10 minutes Raghav left my house abusing and telling me that he had taught me a lesson and he was away when police took his father to the police station on which my wife had earlier complained ( in Jan , 2019). He reached his terrace and asked me for a fight and abused me with the name” Makhi” , I replied back that this is what your father has teached you and have some manners. Then he started approaching me meanwhile his other brother Ridham Anand along with my brother Gagan Anand and my Aunt Sarita Approached and directed all of them to teach me a final lesson.

7)     All of them beat me endlessly, with sticks and even grabbing my testis forcefully with their hand , they even were photographing the incident. It was only when my wife brought your help and on interventions of some neighbours that they were forced to retreat.

 

8)     Mr Sachin, My wife , a police constable escorted me to your police station for reporting and medical examination and finally medical exam was first conducted post 10.30 p.m first at Sarwal Govt Hospital and then referred to GMC, Jammu at 11: 52 p.m.

“I again like to draw your attention to no investigation, no action after  brutal assault on me on 24​^th May 2020 and subsequently my first application/complaint(dated 24th​ ^​ May, 2020) against the assaulters namely Adarsh Anand, his two sons namely Ridham , Raghav and their mother Sarita anand (W/o Adarsh Anand) .It is so surprising as to why there is not single visit by any police official , collection of evidence , forensic examination and recovery of the hockey stick ,after it was clearly established by my MLC report ( Dated 4 June , 2020) that multiple injuries was caused by a​         n blunt object. 

 I had again submitted an application to both Sarwal and Bakshi Nagar P.S on 16/06/2020 but apart from recording statements of me and my other three eye witness, I see no urgency to book, arrest​     , register an F.I.R

Now I like to add and bring to your notice:-

1)     Mr Adarsh Anand has openly threatened and abused my mother, Neelam Anand by physically coming to my mother room on 12/07/2020.

 

2)     He is intimidating and threatening me and my witnesses by sending his emissary to visit my ailing father, who is very seriously ill and undergoing medical treatment at his home.

 

3)     Moreover, he his trying to lower my reputation in family circle /neighbourhood by colluding/ bribing/ intimating people in family/neighbourhood. Also forcing girls living on rent, in house of my other uncle Ramesh Anand ( Qno 337B, Rehari Colony Jammu) by fabricating false and malicious charges against me.

 

I again humbly request you to register my F.I.R as soon as possible and provide me copy of all the witnesses/counter party claims/ witnesses , and apprise me of any other action taken by your police station that would have consequent impact in this case, failing which I would have no option but to approach Mr Sharidhar Patil – IPS, SSP Jammu and go public.”

Justice is again established and common man like me can live with dignity and without any fear
